OP City Council Action Summary - Oct. 21, 2002

  1. Held public hearing for 2004-2008 Capital Improvements Program.

  2. Approved the following Consent Agenda items:

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT - Committee Items:
    1. 2003 Employee Benefits -
      1. Medical – UnitedHealthCare at an overall increase of 10.3 percent to the City;
      2. Dental – Change in provider from Fortis to Delta Dental of Kansas with no change in premiums; and
      3. Section 125 – MHM for administration of the Section 125 flexible spending accounts program with no change in contribution levels;
    2. Transportation Development District – Staff to work with Copaken, White & Blitt in creation of a Transportation Development District in connection with the development of a mall at 135th and Metcalf;
    3. Agreement with Oak Park Investment, L.P., for operating Oak Park Mall parking garage facility;
    4. Global Agreement with Oak Park Investment, L.P., to the Disposition and Development Agreement (DDA) and Ground Lease; and
    5. Amendment – Fine Host Corporation for Assignment and Assumption Agreement to Food Service Management Agreement.

    Staff Items:
    1. Council Minutes – August 19 and September 9, 2002;
    2. Confirmation of investments in the amount of $4,974,010.42 in U. S. Agency Securities;
    3. Expenditure Ordinance No. 10A – Outlining the expenditures from the General Operating Fund for September 26 through October 9, 2002;
    4. Capital Projects Expenditure Ordinance No. 10B – Outlining the expenditures from the Capital Projects Funds for October 3 through October 9, 2002;
    5. Capital Projects Expenditure Ordinance No. 10C – Outlining the expenditures from the Capital Projects Funds for October 10 through October 16, 2002; and
    6. Eleven applications for new and renewal of Cereal Malt Beverage Licenses and Drinking Establishment Licenses; as listed on the agenda.

    PUBLIC SAFETY – Committee Items:
    1. Local Law Enforcement Block Grant – U. S. Department of Justice in the amount of $50,471 with a local match of $5,608;
    2. 2003 Kansas Click Special Traffic Enforcement Program (STEP) Seatbelt Enforcement Grant in the amount of $18,528 awarded by the Kansas Department of Transportation;
    3. 2003-2005 Highway Safety Project Sobriety Checkpoint Grant – Kansas Department of Transportation in the amount of $23,353.41;
    4. FY2002 Seatbelt Innovation Demonstration Program Grant – National Highway Traffic Safety Administration in the amount of $50,000;
    5. Waive bidding process for Sole Source Purchase of intelligence analysis software from i2, Inc., in the amount of $35,300;
    6. Agreement with SHL USA, INC., to provide professional services to assist in the promotional process to the rank of sergeant in the amount of $38,200;
    7. Ordinance No. POC-2405 –Relating to the Public Offense Code concerning unlawful interference with law enforcement officer;
    8. Resolution No. 3290 – Establishing a fee schedule for towing services; and
    9. Ordinance No. TC-1260,XX – Relating to the traffic code concerning operation of vehicles upon streets, highways and public property. Staff Items: Two applications for Renewal of Massage Therapy and In-Office Massage Therapy Licenses, as listed on the agenda. PUBLIC WORKS – Rescission of approval of Ordinance No. CON-2407 – Authorizing and providing for the acquisition of lands of interests therein by condemnation for the improvement of an overflow bypass channel and riprap revetments, as well as surface appurtenances, channel grading, utility relocations and storm sewer modifications to help stabilize eroding banks and lower flood water elevations to help protect two properties located along a reach of Tomahawk Creek beginning approximately 200 feet west-southwest of the southeast corner of Lot 9 and ending approximately 300 feet north of the northwest corner of Lot 11, Block 1 of Estates of Nottingham South, a subdivision of land in the City of Overland Park, Johnson County, Kansas. (I.D. NO. 00-181).

  3. Accepted the recommendation of the FAED Committee to hold a Committee-of-the-Whole meeting for the purposes of considering Option No. 7 in regard to ward redistricting.

  4. Approved eight applications for renewal of Drinking Establishment Licenses and one new application for a new Drinking Establishment License, as listed on the agenda, contingent on receiving state licenses.

  5. Advised the Council that the dangerous and unsafe conditions of the structure at 7715 West 98th Street has been abated and the unsafe structure action has been closed.

  6. Approved Residential Day-Care Permit No. 2002-02 for the American Stroke Foundation at 8700 Lamar Avenue, for a three-year period of time, the maximum number of people in the facility remaining at 15, and 10 stipulations as listed in the record.

  7. Waived bidding process for sole source purchase and approved NS Microwave for purchase of Front Pivot Camera System using funds provided by the Bryne Grant in the amount of $15,804.75 and $5,268.25 from the Police Department Operating Budget.

  8. Approved Change Order No. 3 – Reno Construction Company for additional work in the amount of $155,440 for the 2001 KLINK Resurfacing Project (Metcalf, Indian Creek Bridge to 86th Street).

  9. Approved Addendum from Harworth Construction Company for the 2002 Storm Sewer Maintenance contract.

  10. Approved the following Planning Commission Consent Agenda items, including all stipulations:

    1. Acceptance of Right-of-Way – Final Plat No. 2002-74, 151st and Lowell Shopping Center, 1st Plat, vicinity of southwest corner of 151st Street and Lowell avenue;
    2. Acceptance of Right-of-Way – Final Plat No. 2002-75, 151st and Lowell Shopping Center, 2nd Plat, vicinity of the southeast corner of 151st Street and Antioch Road;
    3. Revised Preliminary Plan for Tomahawk Creek Centre, 7900 West 135th Street; and
    4. Ordinance No. Z-2950 (Special Use Permit No. 2002-22), 9056 Metcalf Avenue, for a five-year period of time to allow a drinking establishment.
