OP City Council Action Summary - Aug. 19, 2002

  1. Held a public hearing regarding the Fiscal Year 2003 Annual Plan and Fiscal Year 2003 Community Development Block Grant and approved Resolution No. 3286, authorizing the Mayor to submit to the Department of Housing and Urban Development the statement of Community Development objectives and projected use of Community Development funds as stated in the FY2003 Annual Plan.

  2. Held a public hearing regarding the establishment of stream setback requirements, Ordinance No. ZRR-2382, relating to the Unified Development Ordinance for the City; establishing stream corridor requirements by adding as new chapter 18.365 entitled “Stream Corridor Requirements”; Ordinance No. SDR-2390, relating to storm sewers in the City; and Ordinance No. NU-2389, relating to weeds within the City. Set a Committee-of-the-Whole meeting to be held on September 9, 2002, to discuss comments and concerns made at the public hearing.

  3. Adopted the 2003 Budget and 2003-2007 Capital Improvements Program.

  4. Approved the following Consent Agenda items:

    PUBLIC WORKS – Staff Items:

    1. Resolution No. 3288 and KDOT Supplemental No. 1 to Agreement No. 51-01 – Secretary of Transportation of the State of Kansas for the KLINK 1R Resurfacing Project, (US)169-46 U-1826-01, on U.S. 169 (Metcalf Avenue) from 86th Street to south of 63rd Street;
    2. Cancellation of KDOT Agreement No. 19-02 – Secretary of Transportation of the State of Kansas for the KLINK 1R Resurfacing Project, (US)169-46 U-1871-01;

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT – Staff Items:

    1. Capital Projects Expenditure Ordinance No. 8B – Outlining the expenditures from the Capital Projects Funds for August 8 through August 14, 2002;
    2. Application for Renewal of Cereal Malt Beverage License – LionsGate Golf Club, Inc., d/b/a Nicklaus Golf Club at Lionsgate, 14225 Dearborn Avenue;
    3. Ordinance No. B-2357 – Authorizing the issuance and delivery of $16,250,000 principal amount of Internal Improvement Bonds, Series 2002 of the City, for the purpose of providing funds to pay the costs of certain improvements; prescribing the form and details of the bonds; and providing for the levy and collection of an annual tax for the purpose of paying the principal of and interest on the bonds as they become due;

    PUBLIC SAFETY – Committee Items:

    1. 2002 Local Law Enforcement Block Grant – Request approval to accept awarded grant to the Overland Park Police Department by the U.S. Department of Justice;
    2. School Resource Officer contracts with the Overland Park schools: Shawnee Mission School District, Blue Valley School District, and St. Thomas Aquinas;
    3. Ordinance No. CMB-2388 – Relating to cereal malt beverage licensing in the City;
    4. Ordinance No. POC-2387 – Relating to the regulation of toxic vapors in the City;
    5. Ordinance No. TC-1260, WW – Amending the Traffic Code adding the Electric Personal Assistive Mobility Device;
    6. Ordinance No. POC-2396 – Relating to intoxicating liquor in public places and on the Convention Center and hotel property;
    7. Waiver of Bidding Process and Authorization to Contract – Noritsu for a digital photo lab processing system in the amount of $108,801;
    8. Waiver of Bidding Process and Authorization to Contract - AVID for purchase of Forensic Video Analysis System in the amount of $35,600.

    Staff Items:

    1. Application for New Massage Therapy business License – Nab Chiropractic Center, 11916 W. 119th Street.

  5. Approved a bid tabulation with J. Warren Company for 2001 Residential Streetlighting in the amount of $43,500.

  6. Approved 14 applications for New Drinking Establishment Licenses, Renewal of Class B Private Club Business Licenses, and Renewal of Drinking Establishment and Caterers Licenses with all contingencies as noted on the agenda.

  7. Approved a bid tabulation with Voice Print International for a Voice Recorder System in the amount of $39,016.50.

  8. Approved the Revised Preliminary Plan for The Village of Overland Pointe in the vicinity of the southeast corner of 135th Street and Antioch Road.

  9. Approved Special Use Permit No. 2002-9 located at 9105 Flint for a one-year period of time to allow a sports and/or recreation facility. Ordinance No. Z-2942

  10. Approved Special Use Permit No. 2002-17 located at 8001 Metcalf Avenue for a 12-month period of time to allow a temporary sales trailer. Ordinance No. Z-2943

  11. Approved Special Use Permit No. 2002-20 located at 9100 W. 135th Street for a three-year period of time to allow a drinking establishment. Ordinance No. Z-2947

  12. Approved Rezoning No. 2002-12 located at 16200 Antioch Road. Rezoning requested from RURJ, Rural District Johnson County to RE, Residential Estates District to allow the construction of a school. Ordinance No. Z-2941

  13. Approved Vacation Right-of-Way No. 2002-7 located at 7837 Metcalf Avenue. ORDINANCE NO. VAC-2393

  14. Approved Utility Easement Vacation No. 2002-8 located at 11405 and 11409 W. 118th Street. ORDINANCE NO. VAC-2395

  15. Modified previous approval of Final Plat No. 2002-42 for Club Villas at Lionsgate 1st Plat in the vicinity of the northeast corner of 143rd Street and Nall Avenue, to allow change of name of street within the plat to Nicklaus Drive.
