OP City Council Action Summary - Apr. 15, 2002

  1. Elected Carl Gerlach as Council President.

  2. Recognized Boy Scout Troop No. 396 from Church of the Nativity, 119th Street and Mission.

  3. Proclaimed April 26, 2002, as Arbor Day in Overland Park.

  4. Approved the following Consent Agenda items:

    PUBLIC WORKS: Staff Items:

    1. Resolution No. 3269 – Declaring it necessary to appropriate private property for the improvement of 135th Street and U. S. 69 Highway; and
    2. Ordinance No. CON-2356 – Authorizing and providing for the acquisition of lands or interests therein by condemnation for the improvement of 135th Street and U. S. Highway 69.

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT: Staff Items:

    1. Council Minutes – April 1, 2002;
    2. Confirmed investments in the amount of $1,478,040 in US Agency Securities; and
    3. Capital Projects Expenditure Ordinance No. 4B – Outlining the expenditures from the Capital Project Funds for April 4 through April 10, 2002.

    PUBLIC SAFETY: Committee Items:

    1. Approval of funds for El Centro for services in the amount of $50,000 to immigrant and minority families living in Overland Park;
    2. Establishment of a Task Force to explore the City’s relationship with the Overland Park Fire Department; and
    3. Agreement with Johnson County Med-Act to provide cooperative emergency medical services and ambulance transports in the City of Overland Park.

  5. Approved Change Order No. 1 from H. E. Miller & Sons Construction for additional work for the 2001 Curb Repair Program in the amount of $199,996.50.

  6. Approved Agreement with Larkin Group Consulting Engineers, Inc., for design of bank stability improvements in a tributary to Tomahawk Creek adjacent to 14122, 14126, 14130 and 14134 Slater (Willowbrook Area No. 1) and adjacent to 8912 West 142nd Court (Willowbrook Area No. 2).

  7. Report from Committee-of-the-Whole meeting – Public hearing to be held at the City Council meeting on Monday, May 13, 2002, concerning the location of the Overland Park Community Center.

  8. Approved Application for New Drinking Establishment License contingent on receiving state license and Certificate of Occupancy – Chili’s of Kansas, Inc., d/b/a Cozymel’s, 6700 W. 135th Street.

  9. Approved nine Applications, as outlined on the agenda, for Renewal of Drinking Establishment Licenses contingent on receiving state licenses.

  10. Approved Application for Renewal of Class B Private Club License contingent on receiving state license from Red Bull Club, Inc., d/b/a The Fox, 7520 Shawnee Mission Parkway.

  11. Approved the low bid of $47,052 from New Beginnings for animal control services.

  12. Approved Request to Extend Premises to Sell Alcoholic Liquor – Chili’s of Kansas, Inc., d/b/a On the Border Mexican Café, 11855 West 95th Street, for an event May 4, 2002, from 4 p.m. to 1 a.m., and May 5, 2002, from 11 a.m. until 10 p.m.

  13. Approved Request to Extend Premises to Sell Alcoholic Liquor – La Cocina Del Puerco of Overland Park, Inc., d/b/a La Cocina Del Puerco, 9097 Metcalf, for an event May 3, 4 and 5, 2002, from 11:30 a.m. until 11 p.m.

  14. Approved Request to Extend Premises to Sell Alcoholic Liquor – RBA Kansas, Inc., d/b/a Chevy’s Fresh Mex, 11900 Metcalf Avenue, for an event, May 4, 2002, from 11 a.m. to 1 a.m, and May 5, 2002, from 11 a.m. to 12 a.m.

  15. Approved the following Planning Commission Consent Agenda items, including all stipulations:
    1. Final Plat No. 2002-12 – LionsGate Marketplace, southeast corner of 143rd Street and Metcalf, for commercial development;
    2. Final Plat No. 2002-13 – Knox Presbyterian Church, 9595 West 95th Street, for a church addition;
    3. Revised Preliminary Plan – 135th Street Business Park, 9120 West 135th Street, to allow a business park development;
    4. Ordinance No. Z-2924 (Special Use Permit No. 2002-02, 9148 Santa Fe Drive, for a five-year period of time to allow a drinking establishment;
    5. Ordinance No. Z-2925 (Special Use Permit No. 2002-04), 4409 West 159th Street, for a ten-year period of time to allow for a 150-foot communications tower.

  16. Approved Special Event Permit No. 2002-70, Vicinity of 13400 West 119th Street, to allow two free-standing banners for a 30-day period of time.

  17. Approved Preliminary Plan for Turf Care Center, Overland Park Golf Course, 12698 Nieman Road, with stipulations a and b.

  18. Approved Ordinance No. Z-2923 (Rezoning No. 2002-01), southwest corner of 137th Street and Metcalf, from R-1 Single-Family Residential to CP-1, Planned Restricted Business District, for a restaurant, with stipulations a through h and the addition of four stipulations, as read into the record.

  19. Announcement by the Mayor that changes would be made in the assignment of Committee chairpersons to be effective May 1, 2002.
